Private securities modeled themselves similar to TSA and other agencies that served the public. Private securities are able to purchase facial recognition software or vehicle tracking software. Federal entities cannot use such software, based on the fact that it could violate the 4 th amendment and privacy issues. Private companies do not have to adhere to the 4th amendment because they are not the government or an extension/arm of the government. So, the software used could be shared with law enforcement, perhaps at a price or a barter. For example, singer Taylor Swift had a stalking case and she used facial recognition software to track her stalker, if he showed up to her venue. She did warn her fans the software would be used during her concerts; however, fans purchased tickets and went to her concerts. Court houses are now all private securities because they can employ software to scan and monitor persons.
